Important:Please read these Official Competition Rules (“these Official Rules”) before entering Disney Channel My School Rocks! 2012 (the "Competition") to be conducted by The Walt Disney Company (Southeast Asia) Pte Limited (“Disney”). By participating in the Competition, you agree to be bound by these Official Rules and represent and warrant that you satisfy all of the eligibility requirements set out herein below.
 
  1. Overview.The Competition is an inter-school dance competition to be held in Malaysia between April and August 2012. Auditions will be held in Malaysia at which each school team will perform a dance sequence to a song from a Disney Channel series or Original Movie.

  2. Eligibility.
    • Entry to the Competition is open only to schools which are located within the territory of Malaysia and for participation by students aged 7 to 17. No purchase by the school or students is necessary in order to take part in the Competition.

    • The Competition is open to amateur performers only. Students performing in an audition must not have appeared in any performance for which they were paid or be subject to any music publishing agreement, recording agreement, production agreement or any similar agreement which would interfere with their ability to enter into the Competition; otherwise, they shall not be eligible to take part in the Competition.

    • Each participating school will have to nominate a minimum of three (3) students and a maximum of eight (8) students from the school to form a team (“Participating School Team”) to participate, at the school’s own cost and expense, in a dancing audition which will be held at a venue in one of four (4) states/cities in Malaysia on the dates as set out below:

    Schools which are located outside of the four (4) states in Malaysia may participate via submission of online entries. The school team will need to record their full performance to one of the selected Disney Channel songs and upload it to www.disneychannel-asia.com/MSR together with the dully filled Entry Form and Release for the team.

    • Each Participating School Team may enter the following categories (individually a “Category” and collectively “Categories”) according to the students’ age groups:
      - Primary Category: 7 to 12 years old;
      - Secondary Category: 13 to 17 years old.

    • Each school may field no more than two (2) teams to enter the Competition. A student may only join one team for the Competition. Students joining more than one team will be disqualified from participating in the Competition.

    • Directors, officers and employees of Disney or its affiliated companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, associate vendors and immediate families of each are not eligible to enter the Competition.

    • All Competition entries must be submitted in English. Competition entries in any other languages will be rejected by Disney.
  1. Competition Period. 
    The Competition is open for registration between 1 April 2012 and 18 May 2012. All registrations for auditions and online submissions have to reach Disney on or before 18 May 2012. The performance video for online entries can reach Disney on or before 15 June 2012 instead. The auditions will be held over the months of June and July 2012.

  2. Participation in the Competition.
    • For both auditions as well as online submissions, each school fielding any Participating School Team should complete and return to Disney all applicable entry and release forms duly signed by the school, parents/guardians of all student entrants and other contributors to the Competition (or their parents/guardians) (each, a “Participant”). Entry into the Competition is by way of the relevant forms that may be downloaded from the website www.disneychannel-asia.com/MSR (the “Website”), as follows:

      - Entry Form and Release for School – to be completed and signed by authorized signatory(ies) of the school

      - Entry Form and Release for Child Participation – to be completed and signed by the parent/legal guardian of each student entrant taking part in the dance.

      - Non-Entrant Contributors Authorization to Use Voice, Likeness, Skill and Name (For Individual 21 Years Old or Above) – to be completed and signed by each adult contributing to the audition behind the scene (e.g. choreographers)

      - Non-Entrant Contributors Authorization to Use Voice, Likeness, Skill and Name (For Individual Under 21 Years Old) – to be completed and signed by the parent/legal guardian of each child contributing to the audition behind the scene (e.g. choreographers)

      (collectively, the “Competition Forms”).

    • For online submission, the video should be no larger than 8 MB in file size.

    • Completed Competition Forms for both on ground audition as well as online submission should be mailed to:

    • Alternatively a school may complete the Entry Form and Release for School that is distributed to the school by Disney Channel visitation crew during the school visitation, and mail the completed form to the above address. Upon Disney’s request, each Participating School Team should procure the completion and return to Disney all other applicable Competition Forms duly signed by parents/guardians of all student entrants and other contributors to the Competition (or their parents/guardians), at the above address.

    • Failure to satisfactorily complete and timely submit all Competition Forms as required herein will result in disqualification of the entry. All Competition Forms remain the property of Disney, may be used in any manner and will not be returned.

    • Each Participating School Team for audition will be notified of its successful registration via an official letter together with a registration confirmation pack from Disney’s appointed event organizer. All Participating School Teams shall receive the official letter no later than 14 June 2012.
  1. Early Bird Incentive for audition participants.
    • The first 50 schools (provided that each of which has successfully registered with Disney) with two (2) registered Participating School Teams (“Early Bird Schools”) shall be entitled to a personal dance training workshop for their Participating School Teams with an experienced trainer who will assist and give them tips to enhance their choreography and dance routine.   

  2. Competition Auditions.
    • Disney will organize for the Competition auditions to be held in Perak, Sabah, Kuala Lumpur / Selangor and Johor in Malaysia in June and July 2012 and will inform each Participating School Team of the details of the venue and date.  The time of the auditions will be scheduled on a first-come-first-serve basis. The Participating School Teams shall be solely responsible at their own cost and expense (including without limitation travel costs, make-up and costume expenses) to be present at the designated venue along with their students at the required time. Failure for a Participating School Team to show up at the auditions on time will result in disqualification of the entry. At least three (3) students must be present in order for a Participating School Team to be allowed to take part in the auditions.Follow the instructions stated in the registration confirmation pack and turn up for the audition at the city that your school has chosen.  

    • Upon receiving the duly completed Competition Forms from the Participating School Teams, Disney will at its sole discretion organize for a particular venue for each eligible Participating School Team and inform the Participating School Teams with details of such venue and the date where the auditions will be held. During the auditions, each team will perform a dance sequence of the full track to one of the songs from the following albums/single used in Disney Channel series or Original Movies (“Official Songs”):

    • No editing or remixing of music is allowed.  Any Participating School Team performing only part of an Official Song or performing any song(s) or music other than the Official Songs shall be disqualified. 

    • Disney may film the audition performance of any Participating School Team.
    • The school of each Participating School Team must procure that all persons attending the auditions, other than students from the Participating School Team, shall each sign an appropriate release form as requested by Disney.

    • Participating School Teams shall have a chance to win prizes for each Category (“Audition Prizes”), which are listed in paragraph 9(d) below) during the auditions.
  1. Selection of Finalists.
    • Judges will be appointed by Disney. Participating School Teams will be judged based on the Choreography (30%), Showmanship (30%), Props and Costumes (20%), Teamwork and Sportsmanship (10%), and Dance Concept (10%) of their dance sequence. The judges' decisions on all matters relating to the auditions will be final and binding and no correspondence or objection will be entertained.

    • One (1) Participating School Team from each of the four (4) audition states and one (1) Participating School team from online submission for each Category will be declared a finalist (a “Finalist”).  There will be five (5) Finalists for each Category (i.e., totally ten (10) Finalists).

    • All Finalists will be announced at the end of the audition day, except for Kuala Lumpur / Selangor where the two (2) Finalists will be announced on the end of the auditions on the second audition day. Each Participating School Teams will need to return, at the school’s own cost and expense, to the respective audition venue for announcement of the Finalists at the end of the audition.  The Finalist will be required to perform the dance sequence again (the “Winning Performance”) after the announcement.  Another Participating School Team will be selected if the originally selected Participating School Team fails to show up at the announcement or is unable to do the Winning Performance. As for the online submission finalist, Disney Channel team will visit them in their hometown to record their performance for public voting.

    • Disney reserves the right to use alternate judging and/or winner selection procedures as determined by Disney in its sole discretion.
  1. Online Voting for Grand Prize Winning Team.
    • The dance sequence of the ten (10) Finalists as filmed by Disney will be broadcast on Disney Channel in Malaysia between 28 July to 12 August 2012.

    • Disney Channel viewers in Malaysia will be asked to vote online between 28 July to 12 August 2012 via the Website for the Participating School Team whom they think is the best out of the five (5) Finalists for each Category. The Finalist for each Category that gets the highest weighed total of the maximum number of eligible votes from the viewers in Malaysia and highest judges points (each weighed 50%) will be selected as the winner of the Grand Prize for such Category (as described below) of the Competition (the “Grand Prize Winning Team”). Only one of the five (5) Finalists will be selected as the Grand Prize Winning Team for each Category.  Disney reserves the right to use alternate voting procedures as determined by Disney in its sole discretion.

    • All voters are subject to these Official Rules and all voters agree to be bound by these Official Rules and Disney’s decisions.

  2. Competition Prizes.
    • The “Grand Prize” comprises the following:
      - The Grand Prize Winning Team for each Category will win a 3-day/2-night trip to Hong Kong Disneyland Resort at a date to be confirmed and notified by Disney. Each Grand Prize Winning Team student must have one (1) teacher from the school appointed as his/her legal guardian for the entire duration of the trip (the “Trip”). Each of the Grand Prize Winning Team students and school representatives can bring one friend along for the Trip. The Trip includes economy class air travel for two (2) school representatives, up to eight (8) student entrants and their guests, from the Grand Prize Winning Team’s originating city to Hong Kong; hotel accommodation in Hong Kong Disneyland Resort for up to twenty (20) persons per team for up to (2) nights (depending on the itinerary); and park admission tickets for two (2) school representatives, up to eight (8) student entrants and their guests, up to twenty (20) persons in total) to the Hong Kong Disneyland Resort.

    • Each Finalist will each be entitled to the “Finalist Prize” that comprises the following:
      - Musical instruments for the school
      - Exclusive Disney Channel goodie bag
      - Certificate of participation for each student entrant

    • The two (2) Grand Prize Winning Teams and the Runner-Up Teams will be announced on Disney Channel on 25 August 2012. The two (2) Grand Prize Winning Teams and the Runner-Up Teams will be notified of the results via telephone followed by an official letter from Disney through their schools.

    •  “Audition Prizes” comprising Disney goodie bags will be awarded to the following prize winners:

    •  Award of the Grand Prize or the Audition Prize (each a “Competition Prize”) is conditional upon verification of eligibility and compliance with these Official Rules including, without limitation, each of the school Grand Prize Winning Team, the Grand Prize Winning Team students and all non-entrant contributors (if any) contributing to the Competition (and/or their parents or legal guardians (if applicable)) agreeing to and signing all appropriate release forms and/or prize taking agreements required by Disney. Failure to timely complete, sign and return any of such documentation as required by Disney or violation of these Official Rules will result in disqualification of the Participating School Team, and forfeiture of any Competition Prize awarded.
    • The Grand Prize Winning Team students and their travel companions must all have passports valid for six (6) months or more from travelling date. The release of the Grand Prize is subject to each of the Grand Prize Winning Team student and his/her legal guardian for the trip obtaining valid visas to Hong Kong as necessary for all travel to be undertaken pursuant to the award of the Grand Prize. Each Grand Prize Winning Team student and his/her legal guardian for the trip are all obligated to show proof of successful visa application to Disney prior to fulfillment of the Trip. All visa application costs shall be borne by a Grand Prize Winning Team student and his/her legal guardian for the trip. Entrants and their parents/legal guardians will need to check with the relevant Chinese embassy, consulate or diplomatic mission for visa application detail.

    • Admission to the Hong Kong Disneyland Resort may be subject to certain terms and conditions. Information may be found at the website: http://hongkongdisneyland.com.

    • All Competition Prizes must be claimed no later than the time limit specified by Disney. In the event of a winner not being able to take up a Competition Prize as detailed, Disney reserves the right to select an alternative winner. Decisions of the judges and Disney are final and no correspondence and/or objection will be entertained by Disney.

    • The Competition Prizes are non-transferable and no cash alternative is available for the Competition Prizes. In the unlikely event that a Competition Prize should become unavailable, or due to unforeseen circumstances, Disney reserves the right to substitute a prize of equal or greater value, as determined by Disney in its sole discretion.

    • As far as is permitted by law, Disney and its associated companies and agents exclude responsibility and all liabilities arising from any postponement, cancellation, delay or changes to any Competition Prize details beyond Disney’s control and for any act or default of any third party supplier.

    • The Grand Prize Winning Teams and any other person that joins the Grand Prize Winning Teams for the Grand Prize trip and related activities (the “Grand Prize Participants”) shall take full responsibility for any and all liability, claims, demands or causes of action that the Grand Prize Participants may hereafter have for injuries or damages arising out of the Grand Prize or their participation in the Grand Prize trip and related activities. The Grand Prize Participants agree that none of them will sue or make claim against Disney for damages or other losses sustained as a result of any injury, or death, sustained from the Grand Prize Participants’ participation in the Grand Prize trip and related activities. The Grand Prize Participants recognize that this release of liability, waiver of legal rights, and assumption of risk is a contract pursuant to which the Grand Prize Participants have released, and released on behalf of any Grand Prize Participant under the age of 21, any and all claims against Disney resulting from any injury, or death, sustained from the Grand Prize Participants’ participation in the Grand Prize trip and related activities, including any claims for negligence of Disney.

    • All expenses not specifically provided for herein are the Competition Prize winners’ sole responsibility.

    • For the avoidance of doubt, the Competition Prize winners acknowledge that Disney shall be under no obligation to use or broadcast any of the recordings and footage of the winners’ performances and/or prize fulfillment.
  1. Taxes. All taxes associated with the receipt or use of any prize is the sole responsibility of the winner. Winners will be solely responsible for all shipping, handling, insurance and transportation costs associated with delivery of any prize (if applicable).

  2. Personal Information. Personal information (“PI”) of Participants and voters will be collected to enable Disney to administer and promote the Competition and contact winners of the Competition Prizes and Voting Prizes. The PI of Participants and voters may be provided to others assisting Disney in this regard, including without limitation sponsors of the Competition, prize suppliers and deliverers, and authorities that regulate the Competition (if applicable). If a Participant or voter does not truthfully provide all requested PI, Disney may solely determine that such Participant or voter shall not be eligible to take part in any way in the Competition or win any prize (if applicable).

  3. Disclaimer. Disney, all participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies shall not be responsible or liable for: (a) any problem, loss or damage of whatsoever nature suffered by any party due to any delay and/or failure (including lost entries, mail delay or loss) in registering for or participating in the Competition as a result of any communication error, interruption, human error and/or failure by Disney and/or any third party; (b) any problem, damage or loss of whatsoever nature to any person, resulting from his/her/its participation in the Competition; (c) any error (including error in notification of prize winners), omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to entries, or entries lost or delayed whether or not arising during operation or transmission; or (d) any changes made by Disney or any third party suppliers or sponsors.

  4. Ownership/Rights.
    • Except as specifically provided for herein, each Participant agrees, by entering into or otherwise taking part in the Competition, one hundred percent (100%) of all now known or hereafter existing rights, titles and interests of every kind in the recording, broadcast, inclusion in any television program service or making available to the public live of his/her/its contribution, participation and performances related to the Competition (the “Participation”) throughout the universe in perpetuity and in all languages in any and all manner, media and formats, now known or hereafter existing shall be released and assigned to Disney absolutely and Disney shall be the sole owner of the entire copyright and all other rights in and to the Participation from the moment such rights come into existence. Each Participant unconditionally assigns and transfers all ideas, concepts, copyrighted materials and trademarks contained in his/her/its Participation and any and all rights including without limitation “moral rights” in his/her/its Participation. Disney shall be entitled to make use of the Participation or any part thereof in such manner as it shall in its sole discretion think fit, including without limitation the right to make changes, alterations, substitutions and additions thereto, deletions therefrom and adaptations and rearrangements thereof and translations into any and all languages for any use, or not used at all. Disney shall also be entitled to use and exploit the Participation in whatever manner, media and format without incurring any liability to any Participant (including without limitation the requirement to pay any compensation in respect of any use or exploitation of the Participation) or making any acknowledgement of the Participation.

    • Each Participant authorizes Disney to, without any need for further consent or payment, use his/her/its name, voice, photograph, likeness, biographical data, logos, particulars (as applicable) and any or all of Participation in any and all manner, media and formats now known or hereinafter invented or developed throughout the universe, in perpetuity and in all languages without limitation. Each Participant also grants to Disney all consents and permissions, including any consents and permissions under any relevant performance protection legislation what would otherwise be necessary to enable Disney to make the fullest use and exploitation of the Participation.
    • Disney may assign all rights granted by a Participant hereunder to any party at Disney’s sole discretion.
  1. Conditions of Entry.
    • By entering the Competition, each Participant/voter agrees to be bound by these Official Rules and by decisions of the judges and/or Disney, which are final as to all Competition-related matters.

    • In addition, by participating in the Competition and/or accepting any prize that he/she/it may win, each Participant/voter agrees to release Disney, its parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors and assigns from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in the Competition and/or acceptance or use of any prize, to the fullest extent permitted by law.   

  2. Participant Indemnification. By taking part in the Competition, each Participant hereby agrees to indemnify Disney against all actions, losses, claims, damages, costs and expenses of whatever nature arising directly or indirectly from any breach by him/her/it of any of the representations or warranties or any term or condition contained in these Official Rules.

  3. Termination/Suspension.  Disney has the sole right to suspend, postpone, cease, close or terminate this Competition at any given point of time at its sole option and discretion.

  4. Copyright Notice. The Competition and all accompanying materials are copyrighted by Disney. All rights reserved.

  5. Miscellaneous. Participants and voters agree to be bound by these Official Rules and by the decisions of Disney, which are final and binding in all respects. Disney reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend or cancel the Competition or any Participant’s or voter’s participation in the Competition should viruses, bugs, unauthorized human intervention or other causes beyond Disney’s control affect the administration, security or proper play of the Competition or Disney otherwise becomes (as determined in its sole discretion) incapable of running the Competition as planned. Participants and voters who violate these Official Rules, tamper with the operation of the Competition or engage in any conduct that is detrimental or unfair to Disney, the Competition or any other Participant or voter (in each case as determined in Disney's sole discretion) are subject to disqualification from entry or participation in the Competition. Disney reserves the right to disqualify persons whose eligibility is in question or who are otherwise ineligible to enter or participate in the Competition.

  6. Governing Law and Jurisdiction. The Competition and these Official Rules shall be governed by and construed in accordance with the laws of Singapore, without regard to the conflict of laws provisions therein. By participating in the Competition, an entrant and his/her parent or legal guardian irrevocably submit to the exclusive jurisdiction of the courts of Singapore for the purpose of resolving any dispute, disagreement, difference, controversy or claim of any kind whatsoever arising under, out of, relating to or in connection with this Competition or these Official Rules.

  7. No Third Party Rights.  These Official Rules are not intended to confer rights on any third party, whether pursuant to the Contracts (Rights of Third Parties) Act (Cap 53B) of Singapore or otherwise, and no third party shall have any right to enforce any provision of these Official Rules.
